Terms of Service

1. What Pitch Back is

Pitch Back is a free service, operated by Sovereign Data Solutions SARL, a company incorporated under the laws of France (“we”, “us”), that connects to your Gmail mailbox, attempts to identify unsolicited commercial prospecting using transparent, deterministic rules, replies with a message template that you wrote, and archives the thread under a “Pitch Back” label. By creating an account you agree to these terms. You must be at least 16 years old to use the service.

2. No AI, no black box

Detection relies exclusively on an open-source rule engine (pitch-back-engine). Replies are your own template, sent verbatim — nothing is ever generated for you. Your email data is never used to train any machine-learning or AI model, ours or anyone else's.

3. Explainability

Pitch Back intentionally avoids opaque automated decision-making. Every automated decision can be inspected, challenged and overridden by the user : each detection lists the rules it triggered, down to their source code; “Mark as legit” reverses any call we made; and enabling automatic replies is always an explicit choice that remains yours — new accounts start in dry-run mode. We believe transparent, deterministic software often builds more trust than opaque automated systems.

4. What Pitch Back is not

Pitch Back is not an email security, spam-filtering or archiving service, and does not guarantee that any particular email will or will not be detected. Detection is heuristic: false positives and missed pitches can and will happen. Do not rely on Pitch Back to protect, classify or preserve your email.

5. Experimental software

Pitch Back is an experimental product under active development. Features may change, break or disappear without notice. You should not rely on the service for business-critical workflows.

6. Your mailbox, your responsibility

Replies are sent from your own email address, using the template you configured. You are solely responsible for the content of your template and for the consequences of sending it. You agree not to use Pitch Back to harass, defame, threaten, deceive or spam anyone, nor to violate any applicable law. You stay in control at all times — dry-run mode, the pause switch, per-sender whitelisting and account deletion are available in the app.

7. Indemnification

You agree to indemnify, defend and hold harmless Pitch Back and its operator from and against any claim, damage, liability, cost or expense (including reasonable legal fees) arising out of the content of your reply template, your use of the service in breach of these terms, or your violation of any law or third-party right.

8. What we access and store

With your explicit OAuth consent, Pitch Back reads incoming messages to analyze them, sends replies on your behalf, and archives threads. We store: your name and email address, encrypted OAuth access and refresh tokens, your reply template, and for each detected pitch the sender, subject line, score and triggered rules. We do not store the bodies of your emails, unless required temporarily to process the current message in memory. Legitimate mail is analyzed in memory and leaves no trace in our database. Detection records are kept until you delete them or your account; technical server logs are rotated after 14 days.

This document does not replace our Privacy Policy, which describes in detail what data we process, why, for how long, and your rights over it.

Pitch Back's use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.

9. Third-party services

Pitch Back depends on services we do not control, including Google APIs, hosting and email-delivery providers. We are not responsible for their availability, changes to their APIs or policies, or any loss caused by them. If a provider revokes or restricts access, parts or all of the service may stop working without notice.

10. Leaving, and the right to be forgotten

You can disconnect your mailbox at any time (Account page), which revokes our access. The Danger Zone lets you permanently delete your account and every piece of data we hold about you, immediately and without a recovery period. You can also revoke Pitch Back's access from your Google security settings at any time.

11. Free service, no warranty

Pitch Back is provided free of charge, “as is” and “as available”, without warranty of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted, error-free or that any detection will be accurate.

12. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special or consequential damage, loss of profits, business or data, arising from the use of the service — including a reply sent to the wrong person. To the same extent, our total aggregate liability shall never exceed the amount you paid for the service during the twelve (12) months preceding the event giving rise to the claim — that is, €0, since the service is free. Nothing in these terms excludes liability that cannot be excluded under applicable law.

13. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of hosting or email providers, API changes or revocations, network failures, fire, natural disasters, war, or acts of any government or authority.

14. Intellectual property

The Pitch Back application, website, name, logo and visual identity are the property of Sovereign Data Solutions SARL. The detection engine and its ruleset are open source under the MIT license; unless otherwise stated, all other software remains proprietary. Your reply template and your email content remain entirely yours — we claim no rights over them beyond what is needed to operate the service.

15. Fair use and termination

We may suspend or terminate accounts that abuse the service, attempt to disrupt it, or use it for anything other than its purpose — including attempts to circumvent Gmail rate limits. We may also temporarily suspend access to protect the integrity of the service. We may modify or discontinue the service; if we ever discontinue it, we will give you reasonable notice to export or delete your data.

16. Changes to these terms

We may update these terms as the product evolves. Material changes will be announced on this page with an updated date above. Continuing to use Pitch Back after a change means you accept the new terms.

17. Contact, governing law & jurisdiction

These terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Paris, France, without prejudice to mandatory consumer-protection rules granting you the courts of your place of residence. Product philosophy

Pitch Back exists to reduce unwanted interruptions, not to create new ones. Its purpose is to help you regain control over your inbox while remaining respectful of others — every reply is polite, written by you, and sent at most once per sender. Automation should remove repetitive work, not encourage harassment. If you ever feel the product drifts from this, tell us.
